ZONING BY-LAW AMENDMENT

NOTICE OF COMPLETE APPLICATION AND PUBLIC MEETING


October 22, 2024 

The Council of the Corporation of the Town of Greater Napanee intends to consider a Zoning By-law Amendment to Zoning By-law 02-22. Pursuant to Section 34(12) of the Planning Act (R.S.O. 1990), Council will hold a public meeting on November 12, 2024, to outline the content and effect of the zoning by-law amendment, as well as showing the lands affected.  All those interested are hereby invited to attend the public meeting and express their view on the Zoning By-law amendment.

PURPOSE

A Zoning By-law Amendment application (PLZACO 2024 025) was received from 12123045 Canada Inc., GDK Holdings Ltd., Gunaraja Thuraisingham and Deepa Gunaraja to permit the re-zoning of the subject lands from Residential Type 4 (R4) Zone to Residential Type 4 Exception XX (R4-XX) Zone, with the site-specific provisions for lot area, lot frontage, yards, landscaped open space, setback from street centreline, lot coverage, parking requirements and distance between driveway and an intersection of street lines.

EFFECT OF THE ZONING BY-LAW REQUEST

The by-law will recognize existing legal non-complying conditions of the single-detached dwelling lots at 90 and 92 Mill Street West, and to facilitate appropriate semi-detached-dwelling-unit development standards for redevelopment residential intensification of an underutilized lot (severed lot) and 91 Water Street West.

LOCATION OF PROPERTY

The properties are located at 90 and 92 Mill Street West and 91 Water Street West. The lands are legally described as:

  • Plan 82 E Pt. Lot 25 S/S Mill St, B25 29RP6957 Part 1
  • Plan 82 N Pt. Lot 25
  • Plan 82 S Pt. Lot 25 S/S Mill St, B25 RP 29R4141 Part 1

All in the Town of Greater Napanee and the County of Lennox and Addington (see key map).

OTHER APPLICATIONS

The lands are subject to application for consent to sever under file number PLCON 2024 023 and application for easement under file number PLEASU 2024 024.

NOTICE OF APPEAL

If a person or public body would otherwise have an ability to appeal the decision of the Council of the Town of Greater Napanee to the Ontario Land Tribunal (OLT) but the person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Greater Napanee before the by-law is passed, the person or public body is not entitled to appeal the decision. 

If a person or public body does not make oral submissions at a public meeting, or make written submission to the Town of Greater Napanee before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal (OLT) unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

PUBLIC MEETING PLACE

The public meeting will be held on November 12, 2024 at 7:00 p.m. at Town Hall 124 John Street, Napanee, Ontario.
