ZONING BY-LAW AMENDMENT
NOTICE OF COMPLETE APPLICATION AND PUBLIC MEETING
February 10, 2025
The Council of the Corporation of the Town of Greater Napanee intends to consider a Zoning By-law Amendment to Zoning By-law 02-22. Pursuant to Section 34(12) of the Planning Act (R.S.O. 1990), Council will hold a public meeting on March 11, 2025, to outline the content and effect of the zoning by-law amendment, as well as showing the lands affected. All those interested are hereby invited to attend the public meeting and express their view on the Zoning By-law amendment.
PURPOSE
A Zoning By-law Amendment application (PLZACO 2025 005) was received from Susan Olayres & Darcy Olayres to amend the zoning of the subject property from “C5 (Recreation Commercial)” to “SR (Shoreline Residential)”. The intention is to correct the zoning of the 0.6 hectare lot occupied by their private residence.
EFFECT OF THE ZONING BY-LAW REQUEST
The application seeks to rezone the area of the subject property shown in red on the attached key map from “C5 (Recreation Commercial)” to “SR (Shoreline Residential)” to reflect its use as a residential property and not as a commercial business.
LOCATION OF PROPERTY
The property is located at 1919 South Shore Rd. The lot is legally described as Concession 3, Part Lot 14, in the geographic Township of South Fredericksburgh, Town of Greater Napanee, as shown on the Key Map.
The land to be re-zoned is as shown on the attached key map.
OTHER APPLICATIONS
The application is not submitted in conjunction with any other application.
NOTICE OF APPEAL
If a person or public body would otherwise have an ability to appeal the decision of the Council of the Town of Greater Napanee to the Ontario Land Tribunal (OLT) but the person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Greater Napanee before the by-law is passed, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting, or make written submission to the Town of Greater Napanee before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal (OLT) unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
PUBLIC MEETING PLACE
The public meeting will be held on March 11, 2025 at 7:00 p.m. at Town Hall 124 John Street, Napanee, Ontario.
